Abstract:Given the importance and application of this condition in banking contracts and its impact on the realization of liability or exemption of banks, it is necessary to study the concept, effects and scope and the possibility or impossibility of invoking this condition. The question is, is such a binding condition known due to the bank's trust? How to combine it with the security duties and inherent commitment of banks to the customer's interest is also an ambiguity about which no comprehensive and independent research has been done, and at the same time, the answer is effective in fulfilling the responsibility or exemption of banks and customer rights. The ambiguity of this condition and its imposition can be criticized and pave the way for numerous lawsuits. The research method is descriptive-analytical and in terms of data collection, it is library.Considering the basis of civil liability of banks, in any case where the mentioned condition is in conflict with the trustworthiness and inherent obligation of the banks to review the documents and pay the credit, there should be no hesitation in not paying attention to this condition and deviating from it. It can be a document for breach or non-observance of the obligation to the bank and exemption from liability. Keywords: Letter of credit, non-liability condition, imposed conditions, serious fault, banks' exemption from liability Manuscript profile

The impact of different risks is of great importance in banking industry on financial sustainability, given its functional entity. Given the lack of consensus on the relationship between financial risks in banks, in particular, in credit risk and liquidity in banks, this research investigates the relationship of these two types of risks and their impacts on financial sustainability in banking industry in Iran during 2005-2014 with panel data method. In this regard, in order to investigate the impact of liquidity and credit risks on financial sustainability, Quintile regression method. The results indicate the negative and significant impact of these two types of risks on financial sustainability in most reviewed decimals. This means that with an increase in financial sustainability, the impact of these two types of risks is reduced. In other words, those banks placed in the higher decimals of sustainability distribution are affected less by credit and liquidity risks. Manuscript profile

Although the development of medical knowledge about human and his organs has caused  better life but some of them caused legal and ethical problems. One of this aspects is Cryopreservation. Nowadays, inside of freezing human organs  complete freezing of whole body is possible, too. That one of its important utilization is human gametes freezing that causes complex jurisprudent, legal, ethical, and social problems. Determination of legal persons for decision about the frozen gametes fate is one of this problems. According to the legal nature of frozen gametes and considering them as property, and as the human gametes are one part of the organs of his body, all of theories about relation between man and his body in law is true in relation between man and his gametes. So, there is a ownership relation between the man and his frozen gametes. Therefore, only the gamete owners can decide about their fate. For having decision about the abandoned frozen gametes the Cryopreservation centers try to have contacts whit gamete owners, but when there is no accessibility to their owners, then they ask the inheritors to decide about them, so if they be inaccessibility situation after that in order to determine their fate as properties, the governor is permitted to make decisions about their disposal or donation for researches. This paper provides a new categorization of balance sheet items for commercial banks by putting them in to financial and operational parts. Results of the study shows that banks with higher net financial assets compared to net operational assets have less incentives for earnings management, which results in higher accruals quality. Furthermore, we have studied the role of loan contract types and capital adequacy on accruals quality. The results show that banks with higher share of fixed-income loan contracts and higher capital adequacy ratio have a better quality of accruals. We also found out that banks which give loans to corporations of leading industries, have less earning management actions, which leads to higher accruals quality. Based on this finding, we have developed a future-looking measure of accruals quality for banks focused on industries which banks put higher portion of the loans on and called it Portfolio Quality Index (PQI).     Manuscript profile

Social and environmental responsibility is inflicted with arbitrary behavior in the Iranian banks because reporting them is optional and there is not a single standard to reassure accountancy services and confirm those reports. The present research relies on content analysis, and the data is collected by library study, electronic (email) or face-to-face interviews. The results showed that pivot categories related to the social responsibility of banks include performing social responsibility through their business transactions as well as special attention to social and environmental issues. Moreover, pivot categories related to reporting the social responsibility of banks involve reporting their undertaken social responsibility, reassuring and supervisory services referring to their reports, reforming accountability and transparency procedures, and maintaining moral values. The results indicate the significant importance of performing the banks' responsibility simultaneously with their business transactions and that using these methods can decrease their economic costs. As for reporting social responsibility of the banks, we refer to their effective use of physical facilities available in their branches with the least economic cost to reflect their social and environmental activities as well as the need for the establishment of supervisory institutions to ensure the performance of the social responsibilities. This research aimed to investigate the association of social orientation and social responsibility with moral behavior in banks managers. This study was a descriptive analytical from type of correlation. The population of research included all banks managers of Varamin and Pishva city in 2016 year. From them 160 person were selected by simple random sampling method and all of them completed the questionnaires of social orientation (Harrison, 2001), social responsibility (Galavandi and et al, 2014) and moral behavior (Swanson and Hill, 1993). Data was analyzed with Pearson correlation and multivariate regression with stepwise model methods. The findings showed social orientation and social responsibility had a positive and significant relationship with moral behavior of banks managers. Also social orientation and social responsibility can predict 33/5 percent of variance of moral behavior of banks managers that in this prediction the share of social orientation was higher than social responsibility (P<0/01). Therefore it is suggest that to improve the moral behavior of banks managers increase the social orientation and social responsibility of them. Also suggest that officials and planners consider the symptoms of mentioned variables and design and implementation appropriate programs to improve the moral behavior of banks managers. The managers and the experts who give credit to the customers are the two groups for whom the financial information relavent to performance is so important. Accordingly, they consider some information like financial ratios to investigate the status of the company on the basis of which they make the appropriate decision. Analyzing the financial ratios has been done since a long time ago. In this study, at first, the importance of the different financial performance criteria was investigated by considering the ideas of the bank experts and by using the technique of AHP. After that, the ratios were put in order of priority and the four main groups were considered in order to get the ideas of the experts and the managers ofthebanks(public and private),therateofincompatibilitywas computed. It is clear that ordering in priority could be used as a suitable guide for the experts and the managers of both private and public banks, according to which they can consider the financial ratios to give credit to their customers and compare it with the ranking technique of horizontal ordering. This study was done to find the difference between the main changes of financial performance, and tried to find a sound relationship between liquidity, efficiency, investment, and profitability among the public and private banks. By using the statistical ways of computing the analysis of variance tow-way within-subjects (ANOVA), it was found that there is no difference between the general financial operations and the decision of the managers of the private and public banks of the two provinces; West Azerbaijan and East Azerbaijan. Then,By using the T-test  it was found that there is no difference between the sub financial operations (such as liquidity, profitability, efficiency and investment) that may affect the decision making process of the bank managers of the private and public banks of the two provinces;West Azerbaijan and East Azerbaijan. In the world economic literature today, the role and importance of the monetary system and, consequently, the banking network as a tool for economic development is evident. There are several factors in creating the fragility of the banking network; one of the important and influential factors is the behavioral error and power indicators of the CEO that lead to irrational and irrational decisions.. The statistical population of this research is 31 banks and credit institutions listed on the Tehran Stock Exchange during the years 1390 to 1399. To test the research hypotheses, multiple generalized least squares regression has been used in the Aetta software. Findings indicate that according to the hypothesis test, the more the effect of behavioral error and CEO power increases, the more vulnerability and fragility of banks increases. The results show that behavioral error and CEO power cause vulnerability and fragility of banks. Manuscript profile

Today, the banking sector is one of the most important pillars of the financial sector. In this study, while expressing the theories related to the relationship between Islamic banking and GDP growth, the effect of loans from Islamic banks as an indicator of Islamic banking activities on the GDP growth of 20 selected Islamic countries for the period of 2010-2017 has been evaluated and the panel vector autoregression model has been used in order to investigate the effect of variables of total banking activity, Islamic banking activity, inflation rate, government expenditures, trade openness and institutional quality on GDP growth. The results show that the relationship between Islamic banking activity and GDP growth is positive and significant. Also, the effect of inflation rate, institutional quality and trade openness on GDP is positive and significant and the effect of government expenditures and total banking activity on GDP growth is negative and significant. Therefore, countries with sound macroeconomic and institutional policies (prudent government expenditures, good regulatory frameworks and high institutional quality) have higher GDP growth. Some market participants believe that with the increase in market volatility and the decrease in the number of small shareholders, a type of stability will be created in the decision-making process of bank management that only considers the interests of majority shareholders. This disrupts market activities and reduces the cash asset reserves of banks based on optimal risk incentives. The aim of this study is to investigate the effect of risk incentives on the market value of banks. This research is a library-based analytical study based on panel data analysis. Financial information from 10 accepted banks in Tehran Stock Exchange during the period from 2016 to 2021 was examined. The results showed that liquidity fluctuations as one of the risk incentives had a positive and significant effect on the market value of banks during the studied period. AbstractIn times of uncertainty, the planning, decision-making and policy-making process in all sectors of the economy is disrupted due to the impossibility of predicting the future. The present study seeks to investigate the uncertainty effects of macroeconomics on investment decisions of Iranian banks over a 15-year period (2004-2018) using the seasonal data of 15 domestic banks experimentally. For this purpose, first the generalized conditional variance of inflation, exchange rate, economic growth rate and oil price indicators is estimated and then the effect of their average weight as an uncertainty indicator of macroeconomics on banks' investment decisions is identified by panel data method. Our empirical results show a significant relationship between banks' credit portfolio variation and macroeconomic uncertainty. In other words, as the macroeconomic uncertainty and banks' inability to predict their rate of returns on different assets increase, they allocate less resources to risky assets and more resources to safe assets. Also, there is a significant relationship between bank's specific risk and its investment decision. In other words, as the variance of bank's specific indices increase, the dispersion of risky assets in bank's portfolio increases.  Manuscript profile

Abstract In the present study, in the first stage, the central bank's policy intervention index and foreign exchange market pressure were calculated, and then, using gentle transfer regression (STR), the effect of central bank intervention on the profitability of the country's commercial banks was investigated. According to the model results; In 24 of the 30 years surveyed, the country's economy has faced increasing pressure from the foreign exchange market. In other words, between 1370 and 1399, the central bank's intervention activities eliminated an average of 24% of the foreign exchange market pressure. Also, the results of STR model estimation show the positive effect of economic growth rate variable on bank profitability and the negative effects of central bank intervention, stock return rate, credit risk, inflation rate and interest rate on the profitability of commercial banks. The negative coefficient of the central bank intervention index can indicate that the central bank, in the face of increasing positive deviations in the exchange rate, is pursuing a decline in the growth of its foreign reserves. In other words, with a further increase in the supply of foreign exchange in the market, its value decreases and the exchange rate return to its long-term path. On the other hand, if there is a negative deviation in the exchange rate of the central bank, by increasing the volume of foreign reserves and reducing the supply in the foreign exchange market, it can increase this rate and approach its long-term path, which is in line with existing theories. This is the context. Manuscript profile

The purpose of this study was to determine the optimal level of risk and optimal capital structure based on the logarithmic model of boundary operating efficiency in banks. In this study ، data envelopment analysis based on logarithmic boundary function modeling with assumption of geometric convexity is used to evaluate the efficiency of each Iranian bank for the performance years under study. Among the 28 factors identified through content analysis and knowledge domain analysis, sixteen factors included inputs, outputs, risk, Capital Structure (Minimum Capital, Minimum Capital Risk and Minimum Leverage Ratio), Bank Level Properties (Bank Size, Return on Assets, Return on Equity, Deferred Facility Rate and Liquidity Rate), Factors affecting efficiency, risk and capital structure of banks are identified. The research method relied on a theoretical-applied research design and a descriptive-deductive inference method. Twenty-five banks were selected from the Iranian banks by elimination method and studied over a six-year period ending on 29/12/97. Validation of estimation models based on coefficients of determination showed that regression equations have high explanatory power in determining the optimal level of risk and optimal capital structure based on different measures and Fisher's significant level of significance and generalizability of the estimated results are significant. In any economic system the role of banks to collect deposits of the banking system (Procurement of resource) and its application in the financing of investment projects (allocation of resource) is very important. Nowadays, Expansion of global markets and increase competition in the markets for financial services is affected the profitability of the banking industry, significantly. Given that the profitability of banks is one of functions of banks and a more profitable bank has more power to deal with negative shocks to the market, Therefore, attention to the profitability index as one indicator of evaluating the performance of the banks and its role in decisions related to the mobilization of resources, financing and resource allocation is essential. in this study To achieve this goal, the affective factors on profitability of commercial banks has been modeled and studied during 2009-2013. The scope of this study contains 8 commercial banks listed on Tehran Stock Exchange including Eghtesade Novin, Parsian, Karafarin, Pasargad, Mellat, Tejarat, Saderat and Sina. The study also is used the Panel ARDL method to achieve the targets. The results of this study showed that, The ratio of shareholders' equity to assets, The ratio of credit to assets, bank size and inflation have a direct and positive effect on the profitability of commercial banks. So, increasing and improvement of this variables increase the profitability of commercial banks in the short term and long term. However, the effect of credit risk on commercial bank's profitability index is negative. So that increasing of this variable deacrease the profitability of commercial banks in the short term and long term. finally, The results of ECM model reveal that the speed of adjustment towards long-run equilibrium is low, So that if the shock enters the model the long time require for correct the short-run and long-run imbalance equilibrium and back model to first equilibrium. The purpose of this research was to analyze the effect of monetary policy on gross domestic product and inflation via house price index as a proxy for other assets in Iran in 1989-2008. For the analysis time series data and vector error correlation method were used. The results showed that in the pattern 1 the positive monetary shocks in the short run increased the product and decreased the prices but, in the long run it decreased the product and increased the prices. The debt shocks of the banks to the central bank in the short run had little effect on the product and the prices.
