Therefore, in this research, we are going to examine what is the position of coercive guardianship in Iranian and American law?Method: This article has been done in a descriptive-analytical way.Finding and Conclusion: Legal custody is a right and obligation that is given to parents to make important decisions in the child's life after divorce. With the passage of time and changes in the laws, the mother also had rights and duties alongside the father. The benefit of the child is the most important change in custody rights, and the courts should give custody to the most qualified person, either the father or the mother, based on the hypothesis of the best interest of the child. . The examination of the legal system of Iran and the United States shows that there are basic similarities and some important differences in the two legal systems of Iran and the United States regarding guardianship and guardianship of children. This has been introduced as a new and effective financial instrument in the financial markets, having the advantages and advantages of futures contracts that can be traded in the secondary markets of stock exchanges and securities. Since the nature of this type of contract as an agreement to buy or sell a certain asset at a certain time in the future and at a specific price, which in many cases leads to physical delivery of goods, is favored by Muslims and even abroad and across borders.         Bargaining agreements play an important role in reducing transaction risk and increasing the efficiency of financial markets and attract cash capital to production units and factories. On the other hand, the lack of accurate knowledge of the nature of this efficient financial instrument has caused doubts in the use and development through this financial instrument and these contracts should not be common in the financial markets as it should be. The nature of the option contract in the primary markets is determined by the seller's commitment to perform a certain legal action in the future in return for the exchange, and in the secondary markets the transfer of a certain right in return. In this study, we intend to study and analyze the nature, characteristics, effects and provisions of option contracts from the perspective of traditional Iranian law and the teachings of Imami jurisprudence by looking at the economic needs and interests of the country. Regarding the various aspects of the case, Imami jurists will finally conclude that the use of optional contracts is generally legal and sharia, and objections such as arrogance and gambling are not relevant in the said contract and Article 10 of the Civil Code can be the best format.
