Judicial discretion in contentious proceedings the International Court of Justice

Abstract :
In judicial proceedings, there is a concept referred to as judicial discretion, which can be described as the right or ability of a judge to decide what should be applied in a specific situation. However, the issue of the legitimacy and limitations of judicial discretion has always been a subject of discussion. Examining this issue in contentious proceedings of the International Court of Justice is the main challenge of this research.
The findings and results of the study indicate that the exercise of judicial discretion, when applied in a regulated manner—bas principles, rules, and guidelines—does not constitute an abuse of power or authority. Regarding the regulatory criteria governing judicial discretion in the International Court of Justice, one can refer to judicial policy, organizational linkage, and the institutional origin of the Court. Furthermore, in contentious proceedings requiring judicial discretion, the Court has the authority to exercise discretion in three areas: jurisdiction determination, applicable law, and procedural rules. In this regard, it must adhere to its established principles and criteria within these domains.
