Abstract: This article tries to shed light on some Islamic foundations and concepts ‎according to which decriminalization becomes either permissible or necessary. Among ‎those foundations is insistence of Islamic teachings on different rights and freedoms of ‎citizens and particularly those return to their privacy. Islamic teachings also insist ‎promotion of good and virtue through free choosing of citizens rather than coercive ‎and external bans and restrictions. This approach, in its turn, requires a minimalistic ‎criminalization and occasionally decriminalization. Sometimes, experimental findings ‎achieved from criminalization suggest decriminalization. Religiously, these experiments ‎are valuable and cannot be belittled or ignored. Decriminalization in its Islamic reading, ‎however, in no way, consists with removal of blame from behaviours which are ‎religiously condemned and evaluated as evil. What is religiously assumed as vice cannot ‎be normalized or destigmatized. However, since criminalization follows some practical ‎considerations, every single evil is not, necessarily, a crime. Moreover, fighting evils is ‎not limited to criminalization or insistence on keeping a behaviour criminal.‎Keywords: Islamic criminal law, criminalization, social control, taʿzirāat, Ultima Ratio ‎principle.‎ Manuscript profile

Desirable indigenous humanities for Iran are sciences and methods that are the product of scientific activities based on the culture, beliefs and needs of Iranian society and are aimed at solving the problems and problems of Iranian society. Therefore, the issues should be designed locally or the ideas should be localized in a proper way and appropriate to the culture and religion of the country, so that the desired result can be obtained from them. The purpose of localization of this theory is to localize the theory, because the theory does not belong to one's own country and it was formed based on the problem of other countries and proceeded based on the belief and cultural foundations of that country and provided a solution, in this case it should be Let's give it a native appearance to be localized, but its essence will not change. AbstractDespite all the advantages to human life, computer-mediated communication has provided a fertile ground for transgressive behaviors. Transgression is a behavior that goes beyond boundaries, conventions, laws, and accepted practices. The way societies confront transgressive behaviors, and the social control methods they employ to decrease these behaviors and reduce their mal-effects are of a high significance. Hence, the current research aimed at instrumentation for the measurement of the factors affecting social control of cybercultural transgressions. In the current research, six steps of instrumentation are presented as follows: 1) Identification and extraction of constructs from literature; 2) Validation of constructs and variables; 3) Validity assessment of item pool; 4) A priori reliability and 5) Post hoc reliability assessment; 6) Construct validity assessment; and also, the results of the instrument implementation including final model’s goodness-of-fit, and power analysis are presented. The results of instrumentation process showed an acceptable validity and reliability for the instrument. The steps outlined in the current research can lead to development of better instruments by researchers. Manuscript profile
