In the cofntext of Thomas Spriggens' theory of crisis, this article argues that, first, issues such as prioritizing individual freedoms and rights over democracy and collective rights, as well as the monopoly of political parties and their becoming state and cartel parties, are the most important signs. There are political crises in liberal democracies. Secondly, this crisis is the result of a conflict of interests between the votes (people) and the heads (ruling elites), and finally, the religious democracy based on the principle of Guardianship of the Islamic jurist, both in theory and in practice, is a response to these crises.         The principle of the autonomy of the will declares that a person’s will is the main source of obligations. Consequently, the will of another person doesn’t result in an obligation against or in favor (of) that person. However, the necessity of creating a contract such as insurance and collective contracts in addition to social needs has led to this principle being addressed in some specifications. One of the most important Exceptions is the obligation on third parties. But what are the meaning(s), nature and effects of this specification? Contrary to the belief of some writers, the obligation on third parties is, in fact, making a person obligor whose will doesn’t play a role in creating that obligation. Regarding the nature of this entity, it should be noted that the obligation against third party is theoretically subject to the general rules of unauthorized transactions.         One of the most important international structures that play a major role in the development of international environmental law is the Conference of the parties in the environmental treaties. However, the Conference of the Parties’ status and legitimacy for environmental regulations, developing and restricting the parties’ obligations and requirements which contained in the environmental treaties and implementation of the treaties by its decisions and resolutions should be addressed. This study is based on analysis of legal inductive. According to this method, some environmental treaties from the 1970s until today which contained the Conference of the Parties’ structure has been collected, analyzed and evaluated. After studying the opportunities and legal capacity of the "Conference of the Parties" for development of international environmental law, the result of this study showed that the environmental treaties’ Conference of the Parties have faced some gaps and limitation. The purpose of this study was to investigate the goals and achievements of COP26 and its impact on Iran's macro decisions.Methods: This study was a study on past COPs and COP26. In this regard, previous and current articles were studied along with the lectures and achievements of the COPs, and the course and evolution of this summit, its strengths and weaknesses, and its results were studied. This article attempts to examine the relationship between the political tendency and the efficiency of Iranian parliamentarians with a case study of the sixth and seventh periods. The main question of this article is how the political tendencies and patterns of election of parliamentarians have an impact on their performance and cooperation with other governmental institutions and the extent of participation?The results of this research, based on a descriptive methodology - an analysis that is a cross-sectional and correlational research in terms of the relationship between data - show that whenever there is a context for healthy political competition and organizational transparency, There are MPs, signs of organized cooperation between the Parliament and other government bodies.         The purpose of the present study is to review challenges and strategies for informed political participation in the election system of the Islamic Republic of Iran. The research method is descriptive-analytic and it relies on the hypothesis that the election system in Iran, in the lack of political parties, is often under the influence of cultural, ethnic, and religious fads and is finally conducted without awareness and in a massive and wide spread way. Some of the proposed strategies in this article include the necessity of referring to other institutions and gatherings such as shopkeepers, mosques, journals, and mass media which can somehow perform special functions of parties like giving information, enhancing political perception, decreasing fads, and removing political indifference among people. The results indicate that as for voters, political participation in Iran faces predicaments such as nativism, ethnocentrism, lack of information, and unawareness. The predicaments related to candidates involve the high number of volunteers, dishonesty in speech, and injustice in campaign procedure. Manuscript profile

        The Kurdistan region has more than 600 kilometers of common border with Iran, which are culturally and historically compatible and have a deep influence on each other in the field of democracy. The question of the research includes: is the formation of political opposition in the Kurdistan region a sign of the transition of this region towards democracy or authoritarianism? The hypothesis suggests although the emergence of the opposition is a sign of minimal democracy, its formation, stabilization, and weakening are proof of the authoritarian structure and functioning of the two main parties in this region. The research method is qualitative (library documents). The results show that the formation of the political opposition in the region was a reaction to the authoritarian rule, but at the same time, it was a sign of the movement of the Kurdish society towards a kind of political and party pluralism.         This study aims to investigate the relationship between cultural capital and political participation of Tabriz Islamic Azad university students in 1393. The study population is 18,540 people and Cochran formula is used for determining the sample size that is 376 people. The research method is survey and data were collected through a questionnaire. To assess the reliability of the measuring instrument, Cronbach's alpha was used. Statistical methods include Pearson correlation, t-test and F test. The results show that, there is a  meaningful relationship between cultural capital and the following variables : political participation (with significance level of 0/001), political awareness (with significance level of 0/001), rate of participation in political gatherings (with significance level of 0/001), the reference group (friends) being political (with significance level of 0/003), the rate of participation in elections (with significance level of 0/001) and level of membership in associations and political parties (with significance level of 0/001). But there is not a significant relationship between cultural capital and taking political positions (with significance level of 0.28). In addition there isn’t a significant relationship between age and gender and students’ political participation. Also, there is a significant difference between students’ political participation and marital status (with significance level of 0/009). The political participation of Tabriz Azad University students with a significance level of (0.001) is higher than average, and their cultural capital with the level of significance of (0.187), is moderate.         In traffic accidents , liability is attributed to the person who is directly involved in the chain of legal acts , and is the perpetrator of the offence ( recklessness, negligence, lack of skills , and failure to observe governmental rules) according to the doctrine of fault ( with certain exceptions) . There are no provisions in Iranian Law for civil liability of third parties(owner, possessor, contractor , etc. ) who provides the vehicle to a person without a driving license . However , civil liability for such persons is expected according to the religious principle of "causation ,” which follows the sequence of other causes . In other words , although these persons were not directly involved in the accident, their action in “providing the vehicle” is a prelude and cause for the act . This article will evaluate such a cause in a sequence of other causes according to the religious principle of causation.The result of the present research shows that basically third parties (owners, occupiers, employers, dependents, etc.) are responsible for the occurrence of an accident and, accordingly, they are responsible for compensating for the damage caused by the legal and jurisprudential basis and as a cause during the causes.         The formation of an autonomous and later federal system in Iraqi Kurdistan has been the product of international political interactions and Kurdish nationalist struggles in the form of political parties. The experience of three decades of Iraqi Kurdish parties in governing, self-governing, developing new democratic institutions, and generating challenges to the growth of democracy means that the Kurdistan Region is a rich place to test the relationship between political parties and political development. The main question is: In the process of political development of the Kurdistan region, what role did the main parties play in the conflict of existing obstacles and resources? The research method is documentary method. Data included library resources, and interviews with ten experts in the field of political development at universities in Iran and Iraqi Kurdistan. Findings show that although the process of political development in this region has not been continuous, dynamic and increasing, but this region with the rule of its parties over the last three decades is moving towards a kind of minimal democracy. The occurrence of these events leads to a fundamental change in the circumstances and conditions of the contracts which makes the implementation of the contract for the obligor with excessive difficulty or unconventional losses. In such a situation, it is necessary to modify the contracts. Based on this need and by considering the increasing expansion of trade exchanges and concluding continuous contracts and inevitable economic developments, the present article investigates the impact of economic fluctuations on these contracts and the possibility of compensating for the imbalance created by resorting to contract modification. Based on the result of the study, it can be concluded that there is a modification of potential contract, but it is impossible by the principles of Feqh due to the proposed shortcomings. However, based on Article 3 of the Code of Civil Procedure and by using legal principles relying on the principle of interpretation of the will of the parties, the principle of good faith and fairness, and judicial procedure; it is possible for the courts to modify and revise the contract. In this study in order to resolve this inequality and imbalance between the parties, attention has been paid to how to apply the principle of due process of law over arbitration in litigation and internet disputes. As a result, due to the lack of free choice and the repetitive role of the actor, this principle requires that the imposition of an arbitration clause be prohibited or restricted before arising disputes as to contracts concluded with consumers. Also, some cases could not be referred to arbitration and should be interpreted in favor of the consumer if there is any ambiguity in the arbitration agreements. But what is important among these are the criteria that an arbitration must consider in order for the vote to be valid.Method: This research was carried out in terms of practical purpose and in terms of gathering information by documentary method and through the study of valid laws and sources, and the obtained information was analyzed in a descriptive-analytical manner.Finding and Conclusion: In order for the arbitrator to be able to issue a valid decision, he must consider the criteria that are provided in the text of the law. In the review of the Civil Procedure Law and the International Commercial Arbitration Law of Iran, these criteria are stated and can be calculated as follows. These cases include maintaining the confidentiality aspect of arbitration, compliance with notification formalities, justification of the decision, eligibility of the parties to the lawsuit and arbitrators, expiry of the arbitration period, non-compliance with legal conditions in the selection of arbitrators, invalidity of the arbitration agreement and non- arbitrariness and non-arbitrability of the dispute. History of partisanship in Iranian society dates back to constitutional era. Establishments, divisions and successive dissolutions of parties from the constitutional era to the date refer to existence of various issues in front of this social phenomenon. Majority of researches in field of political parties are focused on structural factors and macro social as state features, power relations and political culture and party activists action have been less analyzed. Examining the patterns of party activists action in the 60s to 90s solar can help us better understanding of damages in front of this social phenomenon. In this study, with an approach affected by Max Weber's theory of action, relevant texts of the most effective parties in the decades were evaluated. Research results from the study show that party activists action pattern is more emotional and traditional than rational (as required the parties activities and consolidation), therefore the partisan phenomenon is challenged by basic questions. The aim of this study was to investigate the causes of the inefficiency of socio-political parties in Iran after the Islamic Revolution, using the thematic analysis method. This research was applied based on purpose and in terms of method, and quality, and had a descriptive approach. The thematic analysis method was used to analyze the data obtained from semi-structured interviews. The statistical population of the study included 14 knowledgeable people in the field of political sociology and political science as well as appropriate texts for extracting indicators and theoretical literature. In this study, to select the samples, the snowball approach was used and as a standard for the end of sampling, the theoretical saturation method was used. Themes were obtained using two sources of theoretical literature and semi-structured interview.         Parties to a dispute in the stages of civil proceedings have rights and duties. Based on the provisions and legal materials, the aforementioned legal procedure is divided into three stages: the initial stage, the appeal and the final stage. Each of these stages has sections in which the parties have rights and powers. The first stage of civil procedures, in turn, consists of four sections: "Until the first session of the legal procedure", "Until the end of the first session of the legal procedure", "Until the end of the negotiations of the parties", and "End of the legal procedure". These departments play an important role in shaping the prosecution. However, due to the wide range of topics, each of these stages can be studied independently. For this purpose, in this research, after presenting the fundamental issues, we studied the first stage: “until the first session of the legal procedure” from the perspective of jurisprudential premises. Given the concept of the aforementioned stage, the research concluded that, based on the jurisprudential premises, the plaintiff enjoys special privileges at this stage. The most prominent rights of the plaintiff at this stage are “to reject the lawsuit” and “to object to the validity of the document.” Therefore, the plaintiff can enjoy his rights by learning about his rights and legal obligations, and this enjoyment is based on the statements and evidence of jurists. Also, based on the rule of discretion and the principle of freedom of will, as well as from the perspective of jurisprudential principles, the plaintiff is free to enjoy the rights proposed at this stage and also in some cases to fulfill his rights in full at the second stage.
