1 - Age cannot determine the puberty of a girl and a boy

What is always referred to as puberty as the beginning of the responsibilities and limitations of the obligated human being is the reaching of a girl and a boy at a certain age; But regardless of its religious basis, puberty is a natural phenomenon with the actualization of sexual talent and reproductive powers; The same criterion and rule is specified in verse 6 of Surah An-Nisa '. However, in narrations and news, various signs have been set for the interpretation of this stage of sexual ability and several ages have been set for it. Therefore, the lack of unity of basis and criterion in determining the criterion of maturity has caused the plurality of opinions of jurists on this issue; Most of the Imami jurists, citing some hadiths, which of course do not have sufficient and reliable meaning, have placed boys at the age of 15 and girls at the age of nine. The findings of this study show that in the field of understanding the narrations of puberty, what has not been given much attention is the audience at the time of issuing narrations and hadiths. While the Holy Prophet (PBUH) and the infallible Imams (AS) had paid such attention in their tradition and speech and in expressing the rulings, they considered the characteristics of the addressee of the word. Therefore, it can be seen that sexual maturity as the beginning of religious duties is not related to the age specified in the words of the jurists and is different in people affected by climatic conditions and climatic diversity. Inadequate physical, intellectual, and mental growth of a child requiresthe necessity of his extraordinary protection as an undeniable principleadopted in different legal systems. Thus, it is necessary to know thecommencement of childhood which brings about this legal protection.Experts in law have raised three theories concerning the commencementof childhood. They are as follows:1. Birth of foetus alive2. Capability to live on its own out of the whomb or in the laboratory3. Formation and development of spermAuthentic and frequently – quoted Hadiths indicate that a foetus bornalive is entitled to inheritance. So the first theory can be established on thegrounds of these Hadiths.Quranic verses and traditions (Hadiths) identify puberty – the stage inwhich sexual organs are capable of reproduction – as the criterion oftermination of childhood. Nevertheless, child’s property should not beentrusted to him after puberty unless his mental qualification (Rushd) isestablished. Thus, mental qualification is also necessary to reach the stage oftermination of childhood in financial affairs Manuscript profile

The purpose of the present study is to review the age of puberty and its concept from the view of Imāmiyah jurisprudence. The method of study is descriptive-analytic and the results indicate that in the Noble Qur'an, there is no mention of confirmation or negation of a certain age for puberty. Pubic hair and nocturnal emission, not a certain age, have been mentioned as the natural signs for puberty in the verses so it shows that age is not an indicator to determine puberty. The question is whether the age of puberty is merely a religious and binding determination or it is based on some transformations that occur during the adolescence of every human. If it is not a merely binding issue, some other factors such as time, place, nutrition, economy, and … are effective on that. Reviewing the ideas of prior and recent jurists indicates that puberty is not a binding issue, but rather it is an external subject. Signs and symptoms mentioned by the holy legislator for puberty are not as a matter of ends but instruments. Manuscript profile

One of the most important issues in the present era is the age of criminal responsibility in the field of children. Many children who reach the age of puberty do not have the necessary intellectual development in criminal matters. The main question of the article is: can the age set in the Shari'a for a child's religious duty be the same as the age of criminal responsibility or 18 years old? Criteria should be set out in international instruments, including the Convention on the Rights of the Child. There are important principles in criminal law that can be considered as the builder of the criminal justice system. Among the principles in the penal system is the principle of moral responsibility, according to which a person will be responsible if he is mature, wise, and autonomous. Therefore, in criminal responsibility, in addition to maturity, intellectual and psychological development must also be considered. Manuscript profile

After the Islamic Revolution in Iran, article 1210 of the Civil Code was amended and full and growth age, set at 18, was replaced by puberty age of 9 for girls and 15 for boys in lunar years of Islamic calendar. This amendment has resulted in conflict between regulations. The Supreme Court has attempted to solve this conflict and in its decision No. 30-23/12/1985, along with puberty, has required the confirmation of full growth age in financial matters. While in nonfinancial matters, puberty age alone has been considered sufficient, and girls or boys who reach the age of puberty, 9 and 15 respectively, can decide for themselves independently in nonfinancial matters such as their education and the change of their family names. This claim, due to its negative effects and consequences, must be restricted. Additionally, different ages have been referred to in civil law and attempts must be made to overcome such controversies. This paper attempts to introduce one single age as growth age in nonfinancial matters and seeks to harmonize the probable conflicts between regulations based on the benefits of the society and the individuals. It is concluded that, based on the single-clause article concerning growth age of the parties to a contract, 18 must also be considered as the presumption of growth in nonfinancial matters. Pheromones are the chemical matters which secreted from animals and act for regulating animal populations and their social interactions. Mammals sexual pheromones cause various behaviors such as aggressive behaviors, acceleration in puberty, courtship behavior, sexual partner finding, paternal behaviors and pregnancy failing. In this research, we examined the effect of female rat pheromone on the male ratand#39;s plasma levels of testosterone in infancy, puberty and old age. By using special cage, we considered the effect of sexual pheromones without the interface of visual, auditory and tactile stimuli. We used ELIZA method for measurement plasma levels of testosterone in male rats. In 50-day male rats which were not placed next to the female rat (control group), the mean of plasma level of testosterone was 2.83 ng/ml that increased in 55-day (2.95 ng/ml), 60-day (3.03 ng/ml) and 65-day rats (3.58 ng/ml). In 85-day mature male rats which were not placed next to the female rat (control group), the mean of plasma level of testosterone was 7.67 ng/ml that increased in 90-day (8.23 ng/ml), 95-day (9.18 ng/ml) and 65-day rats (10.49 ng/ml). This increasing in p andlt; 0.05 was significant. Although the plasma level of testosterone decrease among of old age (7.77 ng/ml) but in comparison to experimental groups of 150-day (8.83 ng/ml) and 160-day old rats (9.16 ng/ml) that receive female pheromones, plasma levels of testosterone were increase significantly. This finding indicate that female sexual pheromones increase the plasma level of testosterone and reproductive activities in infancy, puberty and old age periods of male rats life cycle. One of the most critical periods of life is puberty, which is a natural phenomenon in the evolutionary process of each person's life. During puberty, the child experiences a variety of physical and psychological changes. The development of physical changes associated with puberty, earlier than usual, is known as precocious puberty which poses serious challenges for the individual. The aim of this study was to investigate the lived experience of girls from precocious puberty. So, eight girls who experienced precocious puberty were selected by convenience sampling method and studied using semi-structured interviews. Sampling was continued until data saturation. In order to analyze the data, the data were first recorded and coded and then analyzed using the colaizzi method. The results of this study indicate that precocious puberty poses additional challenges in physical, psychological and social fields such as role pressure, suspension, and fragile self-esteem. It can be concluded that premature puberty in girls is associated with physical and psychological challenges. In the present study, it was shown that mental problems can go beyond physical problems and create more challenges for people and remain unsolved even in adulthood. Manuscript profile
