Abstract :
Background and purpose: This research aimed to design a model of challenges in the field of acquisition and exploitation of national lands from the perspective of fundamental rights.
Research method: From this point of view, qualitative research strategy and thematic analysis have been used. Therefore, the research data was collected using semi-structured interviews with 12 experts in the field of private law who were selected using the theoretical sampling method; It was collected and it has been coded, analyzed and explained by applying the theme network method through the process of theoretical coding in order to discover the basic, organized and comprehensive themes and design the model.
Findings: The research showed that the conceptual network model of challenges in the field of acquisition and exploitation of national lands from the perspective of fundamental rights includes three comprehensive themes: legal challenges in the field of natural resources, the existence of unstable management in the field of natural resources, neglecting damage. Environmental problems and the loss of natural resources have reached theoretical saturation.
Conclusion: In order to "validate" the themes and the built model, two methods of validity evaluation are used in the communication method and the audit method, and for the purpose of "reliability assessment" are used two methods of reproducibility and transferability or generalizability.
