The Functioning of Electronic Justice in Safeguarding the Rights of Crime Victims, with a Focus on the Status of the Deaf

Abstract :
Modern technologies have facilitated the provision of services such as the service of process, conducting investigations, holding hearings, and issuing judgments through telecommunications equipment, computer technologies, and remote platforms. The application of such technologies has significant implications for the rights of parties to proceedings, most notably by reducing costs, reinforcing security measures, enhancing precision, and expediting proceedings. However, considering the rights of victims — and the observance of their situation regardless of the crimes they suffered — is central to the administration of justice, and may be undermined by certain deficiencies or prevailing approaches within the existing legal provisions or during their application. An analysis of the rights and protections afforded to victims is of particular significance where these victims also experience physical or mobility-related disabilities, including deafness or hearing loss, which complicate their ability to comprehend their rights and proceedings or make themselves understood. This is why particular attention must be paid to the challenges faced by such victims, as the increasing use of information and communication technologies, especially in the context of electronic proceedings, has the potential to profoundly affect their status and the protection of their rights. Therefore, employing a descriptive-analytical approach and drawing upon relevant library resources, this article aims to address the central question of what the primary challenges are for deaf victims within the criminal proceedings process, and how the implementation of electronic justice can contribute to improving their status and the realisation of their rights. To this end, it is structured in three main sections: a theoretical and conceptual framework, an examination of fair proceedings and the specific challenges faced by deaf victims in the exercise of their rights, and an assessment of the impact of electronic proceedings on the rights of deaf victims. The article concludes by presenting its final observations and findings.
