Abstract :
In most of the countries of the world, violation of laws and regulations is considered as an abnormality and causes social blame followed by punishment. In the idea of criminal justice and individualization of punishments, prison sentences also pursue other goals such as reforming and incapacitating criminals in addition to intimidation. However, although these punishments have been able to meet the goals of the theory of reforming and rehabilitating criminals in a few cases, they have not been successful in most cases. Sometimes self-punishment is also a cause of crime and has caused criminals to repeat the crime and even become professionals in the society. After the failure of criminology, correction and treatment, and the identification of the criminogenic nature of penal imprisonment and the resulting damages, such as the waste of financial and moral resources of the society, the inflation of the criminal population in prisons, the collapse of families, etc., and despite the fact that the criminal policy During its legal and judicial era, Iran has been mostly based on criminalism; But the Iranian legislator has recently recognized the need to use imprisonment as a last resort. Therefore, it has been gradually looking for the development of alternative punishments. Based on this, the perpetrators of the penal system have started to reduce the punishment.
