Dispute Resolution Methods for Telemedicine in Iran, England and the United States

Abstract :

The aim of the present study was to resolve disputes arising from telemedicine in Iran, England and the United States. By examining the doctor-patient relationship, we found that this relationship is a contract; under the title of a treatment contract, and the law governing it can be the law of the place of conclusion of the contract, the law of the common residence of the parties, the law of the place of performance of the obligation, the law of the state of the parties or the law agreed upon by the parties. At the level of international treaties, in order to resolve disputes arising from this type of contract, the treatment contract can also be examined under the Rome Convention of 1980 on (the law governing contractual obligations). Article 3 of this treaty, which is perhaps its most important article, under the title of “Freedom of choice”, explicitly accepts the rule of freedom to choose the law applicable to the contract. The results of this study also emphasize that physicians will be more willing to use telemedicine if the legal and regulatory aspects of this technology are clarified. These findings are consistent with previous research that shows that appropriate laws and legal frameworks can facilitate the adoption of new technologies. Since uncertainty in legal areas can prevent physicians from using telemedicine more widely, it is essential that policymakers and legal institutions take effective measures in this area. Therefore, this study shows that the adoption of telemedicine in Iran, similar to many countries, is influenced by factors such as awareness of the technology and familiarity with its legal challenges. Physicians' awareness of the advantages and disadvantages of this technology, along with determining and clarifying its legal aspects, can lead to the wider use of telemedicine. Also, the need for clear and comprehensive laws in this field is seriously felt, especially in countries where this technology is in the early stages of adoption.
