Abstract :

 abstract

There is no doubt among the jurists about the validity of the rule of ``amereh la zarar'' and there is a consensus on its sovereignty and precedence based on the primary evidence. Also, the language of the rule of no harm is the negation of the ruling and the proof of the ruling is not the opinion of the famous jurists, as a result, by insisting on the no harm only, the Shariah requirements and the necessity of contracts are removed, and the proof of a new positive ruling is beyond the power of the rule. With this description, in the judgments of the courts, it is seen that compensation for damages is based on the rule of harmlessness, while after the ruling of al-harm and the removal of the ruling, the need to compensate damages using the rules of loss and attribution or guarantee of iodine is ruled. Besides this case, sometimes in preventive lawsuits, rumors and even in legal forums to prevent accidental events such as the possible collapse of nearby buildings
