Abstract :

The present research was conducted with the aim of investigating the social determination of jurisprudential knowledge by descriptive-analytical method. This research was trying to answer the question whether jurisprudence rules have a cultural-social origin? And what is the influence of cultural and social factors on jurisprudence? The reason for the influence of these factors can be seen in the attention to the immortality and efficiency of Islam, being up-to-date and responsive to emerging needs and attention to social justice. Since jurisprudence is divided into two fixed and variable parts.The social determination of jurisprudence rulings only happens in the field of changing rulings, which makes it necessary to know these factors and the mechanism and extent of their influence as well as the dominant factor. In this article, fourteen factors that have their roots in social developments were identified as influential factors in changing jurisprudence, which showed that these factors play a role in the issuance of jurisprudence. Based on the results of the research, these factors have an effect on the form of jurisprudence and its transformation. It seems that the change due to the above factors is an apparent change in the ijtihad of the Shari'i ruling, which happens as a result of a change in the concept for reasons such as the transformation of the appearance of the reason, the discovery of the case or governmental nature of the ruling, the discovery of the ranking of the ruling, or attention to the normal or rational aspects of the meaning. Falls. . The meaning of this impact can also be seen on the change of fatwa due to the development of science, change of topics; The change of the first ruling to a secondary or government ruling, a change in the criteria of the rulings, or the development of its mandates, or due to jurisprudential realism. It seems that among the mentioned factors, the factors that influence the expediency and lead to the change of the Shari'a ruling are more effective, and sometimes this influence reaches the extent of necessity to change the Shari'a ruling.
