گسترش کمی و کیفی استفاده از اینترنت، شیوه زندگی فردی و اجتماعی انسان را دستخوش تغییر وتحولات بنیادینی نموده و به ارتباطات و تعاملات افراد، به ویژه روابط معاملاتی و تجاری، شکل تازه ایبخشیده است. تغییر و تحولات حاصل از اینترنت، موجب طرح برخی چالش ها و مسائل نوظهور درعرصه های مختلف حقوقی شده است. نظام ادله اثبات دعوی یکی از عرصه های حقوقی متأثر ازفن آوری اطلاعات است که متعاقب تغییر شکل ارتباطات و تعاملات حقوقی افراد در فضای مجازی، باو کاغذ تحولات نوین و پدیده های نوظهوری همراه بوده است. در واقع گذر از نظام سنتی مبتنی بررا می توان تحولی در نظام ادله اثبات دعوی دانست که با معرفی الکترون ورود به نظام نوین مبتنی برهمراه بوده است. سند الکترونیک یا دلیل الکترونیک پدیده ها یا ماهیات جدید و نوظهوری مثلزمینه ساز تحولاتی در نظام ادله داده های الکترونیک ظهور شکل جدیدی از اسناد و دلایل در قالبدلیل به عنوان بارزترین مصداق سند الکترونیک ، اثبات دعوی و نظام ثبت اسناد گردیده است. امروزهجایگاه خود را در نظام ادله اثبات دعوی تثبیت کرده است؛ بنابراین، امروزه در کنار نظام الکترونیکسنتی ادله و اسناد، با نظام الکترونیک ادله و اسناد نیز مواجه هستیم. در همین راستا، مقاله حاضر بهتبیین جایگاه سند رسمی، از حیث امکان و شرایط صدور آن در نظام الکترونیک اسناد پرداخته ومی کوشد ماهیت جدیدی را تحت عنوان سند رسمی الکترونیک، با ارزش و آثار حقوقی یکسان با سندرسمی کاغذی شناسایی و معرفی نماید. پرونده مقاله

The penetration and growth of the Internet, as a key technology of the 21st century, caused to some major changes in all individual and social aspects of human life. Some of these changes, which associated with the evolution and changes in the concepts, including legal and political ones, have become a challenge. Identity as a legal and Government as a political concepts are in those fields which have changed and faced challenges in cyberspace. As, identity is difficult to be verified and authenticated over the internet, it leads to problematic aspects of identification in cyberspace. From the public administrative perspective, in fact, the challenge of identity is one of the legal challenges of e-Government. As e-government becomes a reality, all legal and political policy makers, are in an attempt to overcome the challenges of identification in the virtual environment of the internet. Thus the need for building a new legal framework for identification and authentication, as a key prerequisite of e-Government, becomes increasingly urgent. The present article discusses the legal issues of identity and identification in e-Government and tries to propose the solution to related challenges. پرونده مقاله
