چکیده مقاله :
حاکمیت به معنای مشروعیت یا توجیه قدرت سیاسی بنا به منبع آن به سه دسته ی الهی، غیرالهی و الهی – انسانی تقسیم می شود. آخوند خراسانی با توجه به مبانی فقهی و اصولی خود، ابتدا قدرت مطلقه را صرفا مخصوص ذات خداوندی می داند، و در دو دوره ی زندگی خود ابتدا امور حسبه را از از باب قدر متیقن از اختیارات فقیه و در دوره ی مبارزه ی مشروطه خواهی خود، از اختیارات مومنین و سپس جمهور ملت می داند و در این مرحله متمایل به مشروعیت قدرت سیاسی جمهور ملت می گردد. وی وجه شرعی بودن سلطنت مشروعه را رد می کند و حکومت معصوم را صرفا حکومت مشروع تلقی می کند و تمام حکومت های عصرغیبت را جائر و با تقسیم آنها به عادله، نظیر مشروطه و جابره ، حکومت عادله، نظیر مشروطه که مباشر امور عامهی عقلا و متدینین باشند به صریح حکم عقل و به فصیح منصوصات شرع، بر غیر مشروعهی جابره تلقی می کند.
