Identifying the contexts of law evasion emergence in the urban fabric of Kashan

Abstract :

The increase in law-evasion behaviors, according to empirical evidence and official statistics in Iranian society, especially in recent years, has become one of the significant social issues that requires a thorough examination and analysis of its various dimensions. This research aims to identify and analyze the social and cultural factors influencing law evasion in Kashan to understand this phenomenon better and provide solutions to reduce it. The present study is survey-based and quantitative, with data collected through questionnaires. The theoretical framework of this research draws on the theories of Durkheim's anomie, Putnam's social capital, Hirschi's control theory, Sutherland's differential association, Tyler's procedural justice, and Blau's relative deprivation. Cronbach's alpha coefficient was used to assess the reliability of the questionnaire, which yielded a total alpha value of 0.824. In the validity assessment process, the questionnaire's content validity was considered. The sampling method was probabilistic and proportional to the population size (citizens of Kashan), and data analysis was carried out using SPSS software. The results of the research indicate that law-evasion is influenced by various factors, the most significant of which include procedural justice (perception of fairness in legal processes), social anomie (a sense of normlessness and social disintegration leading to increased law-evasion behaviors), religiosity, in-group social capital (strong ties and relationships within social groups), informal control, law-evasion among friends, and belief in civic norms (adherence to civic values and social responsibility). These variables explain 49.1% of the variance in the dependent variable, law-evasion. The implications of these findings are significant, as they provide a comprehensive understanding of the problem and suggest potential strategies for reducing law evasion in society. Finally, several methods for lowering law evasion in society are proposed, including improving procedural justice in legal institutions, strengthening social cohesion, promoting religious and moral values, increasing social capital, and fostering a culture of citizenship.
