Abstract :
Breach of contractual obligations and the damages that arise from it are one of the main issues discussed and examined in the field of contract law. This breach can take various forms, including failure to fulfill contractual obligations, delay in fulfilling contractual obligations, and delivery of defective goods. In response to this breach of contract, the institution of compensation is foreseen. Of course, the approach to compensation for moral damages in each legal system is different from each other, so that in some legal systems, such as the legal systems of England, different damages are considered, including actual damages, punitive damages, nominal damages, and irreparable damages. This is while in legal systems such as the Islamic Republic of Iran, only material and moral damages that have been directly caused to the victim through breach of contract are recoverable. The motivation and reason for choosing the present topic were several major aspects. First, among the disputes regarding contracts, the most disputes that arise are related to compensation for moral damages, while the Iranian legal system has not been properly updated in this area. Second, the complexity of contractual relations in the current era has also led to the acceptance of numerous models in the field of compensation for moral damages, most of which have been implemented at the level of advanced legal systems such as other legal systems and England, including punitive damages. The objectives of this research are: First, to identify the approach of the three legal systems of Iran and England towards compensation for moral damages. Second, to examine the differences and similarities between these three systems in the field of compensation for moral damages. Third, to provide a solution for the Iranian legal system in the field of compensation for moral damages.
