Abstract :

Abstract

 

Operations True Promise 1 and 2, carried out by the Islamic Republic of Iran in response to the military actions of the Zionist regime, once again raised fundamental questions about the effectiveness, legitimacy, and flexibility of international law in the face of new security threats and violations of national sovereignty. This article focuses on the principles of the United Nations Charter, especially Article 2(4) and Article 51, as well as conventions related to the protection of international persons, and provides a legal analysis of these operations. The main question is whether the rules of international law can revise legal concepts according to the requirements and needs of countries in order to preserve imperative rules such as the principle of non-recourse to force? The findings show that Iran’s actions can be interpreted within the framework of the right to self-defense, countermeasures, and protection of the right of nations to resist. Also, the ineffectiveness of international institutions in responding to repeated violations of human rights and the sovereignty of countries highlights the need to review the structure and procedures of international law. Finally, the article emphasizes the need to strengthen legal mechanisms to counter the use of force and effectively support the sovereignty of countries.
