Abstract :

Identifying the source of the binding force of legal norms constitutes a fundamental challenge in legal philosophy. Diverse legal schools offer distinct explanations for adherence to legal rules. The Natural Law School posits justice as the foundation of legal obligation; the Positivist School attributes binding force to state power; the Historical School locates the source of obligation in a rule's customary acceptance; and within the Islamic Legal School, the divine legislative will establishes the binding nature of legal norms. The conflict-of-interest prohibition rule is an emergent norm within contemporary legal systems, finding significant application in public law. This rule addresses situations where individuals face a clash between public duties and private interests. Under such conditions, the potential for impartial decision-making diminishes, creating fertile ground for corruption. While various jurisdictions have developed distinct legal frameworks to prevent such conflicts, Iran's legal system still lacks comprehensive statutory regulations in this domain, despite the existence of robust jurisprudential (Fiqhi) and legal foundations justifying the rule. Part of this legislative gap stems from insufficient clarification regarding the theoretical bases for its binding force. This article addresses the central research question:What‌ theoretical foundations, according to major legal schools, can confer binding force upon the conflict-of-interest prohibition rule? To answer this, the perspectives of principal legal schools (Natural Law, Positivist, Historical, and Islamic) are analyzed. Employing a fundamental research methodology, the study aims to elucidate the theoretical bases for the binding nature of this rule. Data was collected through library research, and thematic analysis constitutes the primary research method.
