A look at the dimensions and components of the rule of prohibition of double punishment in Islamic law

Abstract :
The principle of prohibition of double punishment is one of the accepted rational principles in today's criminal law. The basis of this rule is that any person who violates criminal laws in the form of a crime should, first, not go unpunished and, second, should not be punished more than once. Given the existence of some general rules in jurisprudence that have ensured that jurisprudence is as dynamic as possible with the requirements of the time, the rule of prohibition of double punishment can be applied to all Islamic punishments. Among the general rules in this field that can be relied upon are the rule of negation of inconvenience and the rule of harm. According to these rules, Islamic laws should not be such that they cause inconvenience or harm to individuals. Therefore, double punishment, which itself means causing harm to individuals and also causing hardship and inconvenience to society, is negated and can be a confirmation of the conformity of jurisprudence with the rule of prohibition of double punishment. The Islamic Penal Code passed in 2013 also accepts this rule only in non-Shariah prescribed punishments. The result of this approach is the imposition of another punishment on a criminal who has been punished by a domestic or foreign court verdict, which is incompatible with justice, which is one of the foundations of this principle, as well as with human rights standards, and leads to political and international problems for the country. By taking advantage of the principles of necessity, non-harm, non-inconvenience, and non-existence, a more comprehensive view of this rule can be taken so that it also includes Sharia punishments (diat, qisas, hudud) so that it poses less of a challenge to Sharia legal standards.
