Abstract :
Abstract
The laws of Iran and France follow the written legal system, and in the legal writings, the principles that exist for interpreting the law and the contract in both legal systems in order to discover the inner intention and will of the legislator and the contracting parties, have been written separately ,but the mentioned principles have never been studied side by side and in a comparative manner ragarding the legal sistem of Iran and France.
In order to investigate this issue, the principles governing the interpretation of Iranian and Franch law, which are also effective in the interpretation of contracts, should be examind separately, their similarities and differences have been revealed and The place of application of these principles and the priority and delay of their use have been shown and finally the authors of the research have achieved this matter with an analytical-descriptive method that many of principles governing the interpretation of law and contract are repeated in both legal systems, and if there are apparently distinct principles in each ofthe aforementioned legal systems, the nature of those different principles can be discovered in the other legal system and with the interpreter's knowledge and mastery in applying these principles in his position and Observing their priority and delay, he can take advantage of the full capacity of that legal system for a better and more correct interpretation of the law and contract
