Examining the Role of Time and Place Elements in the Jurisprudence Subjective Change of Gambling

Abstract :
Undoubtedly, time and place are two key and influential elements in the dynamics of Islamic jurisprudence. The social, political, and cultural transformations of societies through history caused changes in jurisprudence commandments. Some mental and social games such as chess is not an exception to this rule and has experienced significant transformations under the influence of temporal and spatial factors. This research, with an analytical-descriptive approach and using library resources and the examination of various jurists' viewpoints, shows that the change in the understanding and status of games such as chess in different societies has been the main factor of transformation of jurisprudence commandments. Analysis of the adjudications of jurists in different periods clearly demonstrates this change. The jurisprudence commandments of games such as chess has shifted from being forbidden to permissible. This transformation can be attributed to changes in the nature and function games such as chess in various societies, as well as shifts in the understanding of concepts related to gambling and entertainment.
