Abstract :
Some jurists have considered the condition as a part of the price, and others have considered the condition to be an independent condition. Based on the second theory, any invalid condition will necessarily cause the contract to be invalid. A group of jurists consider fulfilling the condition as a pure Shari'ah obligation, on the other hand, some of the jurists have considered the condition to be the cause of the conditional obligation against and subject to a conditional ruling in favor of the conditional. Based on this, on the one hand, the conditional opponent is obliged to fulfill the provisions of the condition, and on the other hand, the conditional has the right to demand it. Therefore, the excuse or violation of the condition does not lead the party to the two ways of terminating the contract or signing the contract for free; Rather, in the line of his traditional rights - that is, the right of termination - the conditional has the right to demand the financial price of the condition. In the pre-sale law, articles 6, 7 and 8 differ from the general rules of contracts, including the recovery of the price paid at the construction day rate, the legal delay penalty provided that it exceeds the agreed amount and its sum with the termination of the contract and compliance with the restrictions for termination in the assumption The increase or decrease of the building area is determined. Therefore, any interpretation of the performance guarantee of the pre-sale contract should be done according to the principles governing the contract, including the protective nature of the law and the principle that the obligor is in the position of full execution of the contract on the assumption of the obligee's violation (Article 8). In the pre-sale contract, on the assumption of lack of parking during delivery, if there is any, what was the intention of the parties is to pay in exchange for the building unit with parking, and the delivery of the apartment without parking was outside the transactional intention of the parties. Therefore, forcing the buyer to agree to the transaction or cancel it, due to the increase in prices, causes loss. Therefore, apart from establishing the right of termination in terms of the excuse of submission or violation of the condition, considering that when the construction unit is delivered; In terms of the fulfillment of the obligation, it is subject to the generalities related to the specified object, its delivery in the same condition as it is at the time of delivery, will result in the release of the obligee's liability, but since the non-allocation of parking for the building unit is due to the fault of the seller, The seller will be the guarantor of the payment of the price
difference, which is the result of Article 278 of the Civil Code.
