Abstract :

Context and purpose: "Conditions of Jurisdiction Agreement in the 2005 Hague Convention and Brussels I Regulations", as two important conventions cited in the European Union, include points that so far no article has independently examined these points. Method: This research was carried out using a descriptive and analytical method. Findings and results: In the Hague Convention, there is a possibility to exclude cases that are strongly related to the interests of the state ratifying the convention, but Brussels has not foreseen such a possibility. The formal terms of the agreement are similar in the two conventions. According to the two mentioned conventions, it is possible to reach an agreement only in international lawsuits, and the selected court in the agreement must be determined exclusively, and the court deprived of jurisdiction should not have exclusive jurisdiction in the matter of the dispute. The Hague Convention, unlike Brussels I, considers the mere establishment of selected courts in two countries to lead to the formation of a non-exclusive agreement. The Hague Convention is applied in cases where at least one of the parties resides in one of the countries committed to it and this country is not part of the European Union, but if, despite these conditions, one of the parties is a member of the European Union, both conventions are applicable.
