Abstract :
Temporal and spatial conditions in various ways, such as changing the subject matter of a sentence or its criterion, etc., affect Islamic precepts and occasionally bring about changes that we have examined in these contexts in the present study. The most important purposes of punishment, including in Islam, are the correction of offenders, so it seems that the form of punishment is not subjective, but rather the result, the correction. One of the important issues facing the implementation of some of the punishments that can be considered as part of the present conditions is the issue of human rights, according to which some of the scope of the punishments are violent, inhumane and in violation of human rights regulations; According to Imamiyyah jurisprudents, it is in the interest of preserving the religion and the Islamic system that it is important and preferable to other interests and necessities, and according to the jurisprudence of the jurisprudence, it is expedient, but jurisprudence.
