Analysis of the jurisprudential foundations of arbitration and comparison with similar arbitration concepts and institutions

Abstract :
Arbitration is known as an effective dispute resolution method for disputes and conflicts between individuals in civil societies, but this institution cannot meet contractual expectations in some contracts, such as international contracting contracts, due to the technical nature of such contracts and the need to complete their subject matter within strictly specified periods. Therefore, quasi-arbitral organizations and institutions such as judicial review, mediation, advocacy, and expertise have been envisaged. Two important features of these institutions are that, first, the individuals who are tasked with resolving disputes are primarily specialists and experts in the field of the contract in question, and second, the decisions of these individuals are binding, although it is possible to appeal their decisions to an arbitration court or courts of arbitration. In this study, after a brief introduction to arbitration and quasi-arbitration institutions, we will distinguish them from the arbitration institution and examine the effects of the conditions for resorting to quasi-arbitration methods on the right of the parties to resort to arbitration. In other words, we must search for the similarities and differences between quasi-arbitration and arbitration methods.
