Abstract :
The principle of ensuring the safety of individuals in the community and of justice and non-discrimination between individuals derived from human dignity is the source of the creation of rights and responsibilities and duties for human beings. And this is not a stand-alone right. Accordingly, Article 57 of the Citizenship Law is charged on the basis of principles such as the principle of innocence and the principle of the legality of the offense and punishment and the independence and impartiality of the judiciary and judges and the right to defense and the personal nature of the criminal liability and the permission of the attorney's right of access to the lawyer. In this paper, we answer the question of whether these principles are based on Shari'a principles. In response, all these principles are rooted in the sacred Islamic law, and our religious leaders strongly emphasized these principles.
