Compensation for Environmental Damage in Light of Article 75 of the Rome Statute and "the Elements of Crimes"

Abstract :
Field and Aims: In recent decades, the need to ensure an effective protection of the environment has become more pressing. The significant efforts that have been made by the international community have led to the adoption of conventions and treaties aimed at ensuring the protection of the environment. These remarkable developments in the field of international environmental law, however, have not yet reached the traditional system of international criminal law. Indeed, the ICC remains concerned exclusively with the prosecution of the core crimes already subjected to its jurisdiction. In this article, we investigated the answer of this question: which are the potency of The Statute of the International Criminal Court for Prosecuting environmental damages?
Method: The research method is descriptive-analytical approach and the data collection tool is library metoth by studying books, articles and international documents (declarations, treaties, approvals of international authorities, etc.)
Finding and Conclusions: Our analysis suggests that, however the only explicit mention of the environment in the Rome Statute appears in Article 8.2(b) (iv), under the heading “War Crimes” ,But there are 6 the other potency in “ Elements of Crimes”[1].So We should not underestimate the power of simply relying on the existing statutory framework. We should rather than surrendering the pursuit of "environmental justice" before the ICC ,Focus on reorienting on maximising the environmental potential of the current statutory framework.
