Abstract :
corporal punishments is one of the traditional tools in various penal systems, especially in Islamic jurisprudence, aimed at achieving objectives such as deterrence, rehabilitation of the offender, and the execution of justice. In Islamic jurisprudence, These punishments are based on Islamic law and the ijtihad of jurists. However, in the contemporary world and in light of human rights developments, these punishments have faced serious challenges. From a human rights perspective, corporal punishments are regarded not only as inhumane acts but also as violations of the fundamental principles of human dignity. This article, through an in-depth analysis of Islamic jurisprudence and its adaptation to human rights principles, examines the possibility of modifying or replacing these types of punishments and offers solutions for adapting Islamic rulings to human rights. This article also attempts to examine and analyze the position of corporal punishmentS in Islamic societies from a jurisprudential, legal, and international perspective

منابع خارجی: Foundations of corporal punishments by a jurisprudential approach Punishment is a social reaction against the criminal phenomenon. This reaction can make the goals of punishment. Corporal punishments, as a kind of it, execute to maximize the deterrence and elimination of crime committing and repeating of crime. Tangible and undeniable violence of these punishments make them different through other kinds. This corporal violence cause a bit more intimidation by the society. The extension of Humanism creates some critiques about the violence and fear of these corporal punishments. Some critics claim that these kind of punishments cannot achieve the goals of justice system. These critics express that there is no appropriate basis supporting these kind of punishments. Therefore, it is so important to find the foundations and basis of these punishments and this essay is on to it.
