Strategies for supporting the right of public access to medicine against the rights of inventors of knowledge-based medicines, with a case study of the Corona vaccine

Abstract :

 

In critical conditions and existence of epidemics including COVID19. medicines play important and fundamental role and influence human’s life.After prevalence of corona virus around the world.less.developed or developing countries confronted shortage or basically lack of corona vaccine.of course.achievement in the field of pharmaceutical inventions also has a lot of human benefits.but.unrestricted support of these inventions is incompatible with individuals’ right to health as a fundamental right for human.therefore,one of the important challenges which legal systems confront with.is existed conflicts in supporting intellectual property rights resulted from pharmaceutical inventions and right to health in human societies.In this research.we aim to answer these questions that in general.can intellectual property restrict or forbid right to health and access to medicines for public in critical conditions.And.can utilization binding permission and coalition agreements enhance access to medicines.Also.how influential can knowledge enterprise be in this field from legal perspective.Purpose of this paper is considering how governments cooperate universally based on good faith principle and endeavor for achieving human basic rights namely right to life and right to health.Result of this paper is that according to rules of intellectual property and right to health and creating balance between these two important cases.if owners of invention right create prohibitions.this matter can be confronted with by help of appropriate solutions like preferred and different pricing for expensive medicines.coalition agreements and compulsory license of utilization permission of pharmaceutical inventions.and also influence of pharmaceutical knowledge in knowledge enterprises that causes discovery of strategy of these enterprises in confronting corona consequences.
