Abstract :
Introduction: Objective: This study was conducted to investigate the judgment of women in the Constitution of the Islamic Republic of Iran in the light of the verses of the Holy Quran, taking into account the jurisprudential, religious and religious aspects in order to revise, amend and explain Article 163 of the Constitution. Research Method: Analytical-descriptive is a case study and evaluation that has been done in a library style with content analysis and inference and reasoning. Conclusion: The findings of the present study show that there is no verse in the Holy Quran that explicitly and clearly denies the competence of women to hold the position of judge. . The verses about judging in the Holy Qur'an do not make the correctness of judgment conditional on observance. Therefore, considering that the Constitution of the Islamic Republic of Iran is determined according to jurisprudential standards, Article 163 of the Constitution needs to be amended, revised and explained.
