Validity and ability to cite blockchain evidence in lawsuits regarding intellectual property rights

Abstract :
The protection of intellectual property is evolving with the advancement of technology, and this has an impact on the formation of evidence of a new nature. In this context, the role of blockchain is important as a tool to protect intellectual property rights, which can create blockchain proofs. The findings and results of this research, which have been analyzed in a descriptive-analytical manner, indicate that intellectual property is a form of property that is divided into two major categories: industrial property and literary and artistic property. Industrial property can include various types including patent certificates, industrial designs, trademarks, geographical indications and trade secrets. One of the technologies that can be used to protect intellectual property rights is blockchain, which is a data structure or method of storing digital records in a decentralized manner. As a result, this approach is robust, unbackable, transparent and most importantly immutable. In this process, we are witnessing the creation of blockchain proofs that can be used to prove intellectual property. In the review of Iranian regulations, blockchain evidence is among the documents, and if it meets the criteria of Article 1287 of the Civil Code, it can be among the official documents. Also, the claim of forgery regarding blockchain documents is different from the claim of forgery regarding paper documents.
