Abstract :
The purpose of the research is to examine the ruling on the obligation of education from a jurisprudential point of view, and its method is documentary-analytical based on the evidence of the book, Sunnah, consensus and reason. Education is a continuous and dynamic process in the direction of all-round development (physical, cognitive, psychological, emotional, social, etc.) of the child in order to achieve his existential perfection. Education in Islam has a value and normative nature and must be done in the direction of getting closer to God, and it is inevitable to do so in all schools. it is inevitable to do so. The question of research is the reaction of jurisprudence in the face of the ruling on the obligation of education. The findings show that jurists based on evidence of ijtihad in different areas of education; Especially religious and moral education have ruled on the necessity of education. This important thing is considered to be obligatory either independently or because of its preamble, and the jurists have at least considered it to be a sufficient type of obligation. The education of children is considered obligatory based on the specific evidence of the family group and the government. It is obligatory on the family, in addition to custody, in all fields of education; Especially, they should undertake the religious and moral education of their children, and it is also obligatory to provide the basis of education in the society and by using educational institutions, to make people aware of the importance of religious and moral education. On the other hand, just as the jurists have considered the action of education as obligatory, they have considered it haram for parents, legal guardians, educators and guardians of educational institutions to abandon this important task Undoubtedly, the realization of this requires criminalization and executive guarantee from the legislator
