ملخص المقالة :
در کشور ما دعوایی که در آن خواهان از عموم مردم عادی و خوانده یک دستگاه دولتی باشد، معمولا کمتر مشاهده می شود. اما با مطرح شده یک دعوا از سوی یک سازمان غیردولتی یا یک شخص حقیقی می‌توان به این مساله امیدوار بود که طرح دعوا ی محیط زیستی در مسیر بلوغ و توسعه سیستم قضایی نقش بسزایی دارد.
این پژوهش بر اساس مطالعات کتابخانه ای و فیش برداری و به روش توصیفی نگارش شده است.
نگاه ویژه به حق شکایت محیط زیستی توسط دادخواه خصوصی و نگاه حقوق بشری به آن، بسط و توسعه در نیل بسوی تحقق اصل دادخواهی محیط زیستی و همچنین رویکرد صلاحیت مرجع قضایی و تامین خسارات محیط زیستی از جمله یافته های این پژوهش است.
در این پژوهش ضرورت شناسایی حق دادخواه خصوصی جهت طرح دعاوی و دفاعیات محیط زیستی مورد واکاوی قرار گرفته و ظرفیت های قانونی اعم از قانون مسئولیت مدنی، قوانین خاص محیط زیستی و قوانین آیین دادرسی بخصوص در حوزه مدنی مورد توجه بوده که به نظر می رسد این مساله نیازمند چارچوب نظام یافته است.
