ملخص المقالة :
ساخت جزایز مصنوعی براساس کنواسیون 1982 دریاها مجاز شناخته شده است وکشورها مجاز می باشند در حوزه حاکمیتی خود مبادرت به ایجاد جزایر مصنوعی نمایند. ساخت جزایر مصنوعی درحوزه خلیج فارس سبب شده تا این موضوع با حساسیت بیشتری از سوی کشورهای منطقه به ویژه ایران دنبال شود. با توجه به اصل اطلاع رسانی در حقوق بین الملل محیط زیست کشورهای سازنده جزایر مصنوعی باید اطلاعات لازم را در زمینه ساخت و ویژگی های جزایر مصنوعی خود به کشورهای دیگر ارائه دهند.امروز ساخت جزایر مصنوعی در حال گسترش بوده و باعث بروز بحران های زیست محیطی بسیاری از جمله افزایش تیرگی و گل آلود شدن آب و جا به جایی رسوبات کنار ساحل شده است. در این مقاله آثار تخریبی ساخت جزایر مصنوعی در محیط زیست خلیج فارس و تاثیر گسترش فضای سرزمینی و جدید از منظر ژئوپولیک و همچنین ساخت جزایر مصنوعی از منظر حقوق بین الملل دریاها مورد بررسی قرار می گیرد. افزودن براین که با توجه به تعدیل مفهوم حاکمیت در حقوق بین الملل مدرن در زمینه استفاده از محیط زیست و توسعه پایدار، کشورهای سازنده این جزایر و کشورهای ساحلی حق ساخت این جزایررا به صورت محدود خواهند داشت.
