ارزیابی اعتبار مفهوم ژنوسید در زمان: نگاهی جامعه شناختی

شتاب روزافزون تغییرات زیرساختی و روساختی در جامعه بین‌المللی رشته‌های نوظهور چون حقوق بین‌الملل کیفری را نیز از گزند خود مصون نداشته و به ویژه در جریان رسیدگی دادگاه‌های بین‌المللی و مواجهه با واقعیات، نقابِ بی نقص بودن قواعد درهم می‌شکند و ضرورت بازنگری در قواعد موجود را برای پاسخگویی به نیازهای بین‌المللی و برقراری عدالت راستین پیش می‌کشد. سازماندهی این نوشتار به منظور سنجش اعتبار مفهوم ژنوسید با بهره‌گیری از شاخص‌هایی غیرحقوقی است تا ما را به مطلوب خود که کارایی و به جریان درآمدن قواعد حقوقی در سیستم حقوق بین‌الملل است نزدیک‌تر نماید. عصاره مطلب در این کلام خلاصه می‌شود که تعریف ژنوسید در حقوق بین‌الملل از اعتبار سابق برخوردار نیست و باید در اندیشه همسو نمودن آن با جریانات واقعی زندگی در جامعه بین‌المللی بود. تقابل تعریف کنونی ژنوسید با تعاریف جامعه شناسان راهی به سوی ارائه تعریفی موثر از این جنایت خواهد بود. خاطرنشان می‌شود این پژوهش براساس روش جامعه‌شناختی حقوق و بهره گیری از رهیافت انتقادی، رئالیستی و همچنین روش پدیدار‌‌شناسی به ارزیابی اعتبار مفهوم ژنوسید پرداخته است.
