جایگاه کثرتگرایی فرهنگی در آینه اجماع هنجاری نسبت به اخلاقزیستی در سطح جهانی

چکیده
رشد وتوسعه روزافزون علم وفناوری سبب افزایش ضرورت اتخاذ قواعد اخلاقی مبتنی برحقوق بشردرسطح بینالمللی میگردد. بدینترتیب، اسناد واعلامیههایی دراین حوزه دریونسکو، بعنوان رکن ذیصلاح نظام ملل متحد، به تصویب میرسد که «اعلامیه جهانی اخلاقزیستی وحقوق بشر» ازمهمترین آنها بحساب میآید. لیکن دربسترجهانیشدن ودرمیان تنوع بیحدوحصرفرهنگی نوع بشر، تاچه اندازهای امکان تحقق اخلاقزیستی درقالب سندی همانند اعلامیه جهانی اخلاقزیستی وحقوق بشر وجود دارد؟
برای پاسخ به پرسش فوق، با روشی مبتنی برتحلیل اسنادی به بررسی روند رایزنیها ومذاکرات تدوین پیشنویسها ومتن اعلامیه، درسه مرحله مقدماتی، تهیهپیشنویس توسط کمیتههای بینالمللی وبیندولتی اخلاقزیستی و در نهایت مرحله ارزیابی کارشناسان دولتی، پرداختهمیشود. بررسی کیفیت مذاکرات درفرایند تهیه متن ونیزادبیات اعلامیه مصوب حکایت از روندی مشورتی، آزاداندیشانه ومبتنی براجماع عملگرایانه با محوریت مفاهیم مستخرج از«خیرمشترک» بشری منطبق با تنوع فرهنگی کشورهای عضودارد.

The growing and ever-expanding development of science and technology increases the necessity of adopting ethical norms based on human rights at the international level. Accordingly, various instruments and declarations in this field are adopted within UNESCO, as the competent body of the United Nations system, among which the Universal Declaration on Bioethics and Human Rights is considered one of the most significant.
However, in the context of globalization and amid the boundless cultural diversity of humankind, to what extent is it possible to realize bioethics through an instrument such as the Universal Declaration on Bioethics and Human Rights?
To answer this question, using a document-analysis method, the study examines the process of consultations and negotiations surrounding the drafting of the preliminary versions and final text of the Declaration across three stages: the preliminary phase, the drafting carried out by the International and Intergovernmental Bioethics Committees, and finally the stage of governmental expert assessment.
An examination of the quality of negotiations in the drafting process, reveals a consultative, open-minded, and pragmatic consensus-building approach centered on concepts derived from the common good of humanity, consistent with the cultural diversity of the Member States.
