چکیده مقاله :
حق اشتغال معلولان از یک سو بنا به ملاحظات شهروندی، دغدغه اکثر اسناد عام و خاص حقوق بشری، اعم از بینالمللی و منطقهای قرار دارد و از دیگر سو، به دلیل مقتضیات خاص جسمی و ذهنی شهروندان ، ممکن است نیازمند تعهدشناسی ویژه از جانب دولت ها ، بنا به ملاحظات رفتاری و الزامات حمایتی باشد. در این میان، اصل برابری فرصت شغلی و اصل منع تبعیض که بنیادیترین اصل در تمامی اسناد حقوق بشری و قوانین داخلی هستند، دولت را به مثابه نهادی مسئول و متعهد هدف میگیرد و بر آن است که تعهد دولت در زمینه حقوق معلولان با عنایت به موجه بودن تبعیض مثبت، مستلزم باز تفسیری از حقوق و تکالیف مربوطه است. در نظام حقوقی ایران به موجب قانون جامع حمایت جامع حمایت از حقوق معلولان تقریباً تمام ارگانها و سازمانهای دولتی، نیمه دولتی، نهادهای عمومی و انقلابی و حتی بعضاً خصوصی و غیرانتفاعی را ملزم به حمایت فرهنگی، اقتصادی، اجتماعی و آموزشی شهروندان معلول مینماید و به عنوان نخستین قانون که چنین نگاه وسیع و گستردهای به مسائل معلولان دارد، دارای اهمیت است. . با وجود این، در اجرای سیاست ها وقوانین کاستی هایی از جمله در به کارگیری شهروندان معلول در مشاغلی که استعداد و توانایی انجامشان را دارند به خاطر نداشتن ظاهر مورد قبول جامعه، مشاهده میشود. از این رو نگارندگان در نوشتار حاضر،در تلاشند تا در پرتو قوانین موضوعه و تأکید بر تعهدات دولت، امکان بهره مند سازی شهروندان معلول را از حق اشتغال ایشان در جامعه، بسنجند.

In Iran's legal system, according to the comprehensive law on the comprehensive protection of the rights of the disabled, almost all governmental, semi-governmental bodies and organizations, public and revolutionary institutions and even sometimes private and non-profit organizations are required to provide cultural, economic, social and educational support to the disabled citizens. The title of the first law, which has such a broad view on the issues of the disabled, is important. Despite this, shortcomings are observed in the implementation of policies and laws, including the employment of disabled citizens in jobs that they have the talent and ability to do because they do not have the appearance accepted by the society.
