کنترل، پیشگیری و مقابله با خشونت علیه زنان در قوانین موضوعه ایران

چکیده مقاله :
خشونت علیه زنان ، علاوه بر آسیب های وارده به خود بزه دیده و آثار کوتاه مدت و بلتد مدت آن بر روی زندگی افراد خشونت دیده، با توجه به منزلت و جایگاه حقوقی زنان در هر اجتماعی، دارای عواراض و پیامدهای زیاد سیاسی، اقتصادی، اجتماعی و... می باشد. بنابراین با توجه به تمامی آثار سوء آن در زمینه های گوناگون و به تبع آن به وجود آمدن معضلات و مشکلات حقوقی در رابطه با این پدیده، شناخت قوانین موضوعه در رابطه با کنترل، پیشگیری و مقابله با این معضل دارای اهمیت می باشد. در همین راستا، این پژوهش در ابتدا به بررسی قوانین و مقررات موجود در رابطه با مقابله و کنترل خشونت علیه زنان در قوانین موضوعه ایران پرداخته و با اشاره به وجود تورم قوانین در این حوزه با به چالش کشیدن خلاء ها و کاستی های موجود و عدم هماهنگی های لازم بین ارگان های تقنینی، اجرایی و قضایی در رابطه با موضوع و حتی بیان نقاط قوت قوانین موجود، موضوع را مورد بحث قرار داده و به این نتیجه رسیده است که تصویب و اجرای قوانین بدون کارشناسی همه جانبه و یا تصویب و اجرای قوانین موردی بدون توجه به آثار آن ها نه تنها کمکی به پیشگیری و مقابله با خشونت های علیه زنان نکرده بلکه موجب تضییع حقوق آنان نیز شده است.
Violence against women, in addition to the harm done to the victim and its short-term and long-term effects on the lives of victims, due to the status and legal position of women in any society, has many political, economic and social consequences. Therefore, considering all its negative effects in various fields and consequently, the emergence of legal problems and difficulties in relation to this phenomenon, it is important to know the relevant laws regarding the control, prevention and confrontation with this problem. In this regard, this study first examines the existing laws and regulations related to combating and controlling violence against women in the relevant laws of Iran and by pointing to the existence of inflation in this area and through the challenging the existing gaps and shortcomings and lack of Necessary coordination between the legislative, executive and judicial bodies in relation to the issue and even expressing the strengths of the existing laws, has discussed the issue and has come to the conclusion that the adoption and implementation of the laws without comprehensive consideration or the adoption and implementation of the laws without paying attention to their effects not only has not helped the prevention and prevent and combat with violence against women, but also violated their rights.
