طراحی مدل چالش‌های حوزه تملک و بهره برداری از اراضی ملی از منظر حقوق بنیادین

چکیده مقاله :
زمینه و هدف: پژوهش حاضر درصدد طراحی مدل چالش‌های حوزه تملک و بهره برداری از اراضی ملی از منظر حقوق بنیادین بوده است.
روش بررسی: از این نظر از راهبرد پژوهش کیفی و از تحلیل مضمون بهره گرفته است. لذا دادههای پژوهش با استفاده از مصاحبهی نیمه ساختاریافته با 12 نفر از خبرگان حوزه حقوق خصوصی که با استفاده از روش نمونهگیری نظری انتخاب شده بودند؛ گردآوری گردید و با کاربست روش شبکهی مضامین بواسطه فرایند کدگذاری نظری در راستای کشف مضامین پایه، سازمان یافته و فراگیر و طراحی مدل مورد کدگذاری، تحلیل و تشریح قرار گرفته است.
یافتهها: پژوهش نشان داد که مدل مفهومی‌شبکه ای چالش‌های حوزه تملک و بهره‌برداری از اراضی ملی از منظر حقوق بنیادین از 3 مضمون فراگیر: 1- چالش‌های قانونی و حقوقی در حوزه منابع طبیعی، 2- وجود مدیریت ناپایدار در حوزه منابع طبیعی، 3-بی توجهی به آسیبهای زیست محیطی و اتلاف منابع طبیعی به اشباع نظری رسیده است.
نتیجه گیری: جهت «اعتبارسنجی» مضامین و مدل برساختهشده، از دو روش ارزیابی اعتبار به شیوهی ارتباطی و نیز روش ممیزی و به منظور «پایاییسنجی» از دو روش قابلیت تکرارپذیری و نیز قابلیت انتقال یا تعمیمپذیری استفاده شده است.
Background and purpose: This research aimed to design a model of challenges in the field of acquisition and exploitation of national lands from the perspective of fundamental rights.
Research method: From this point of view, qualitative research strategy and thematic analysis have been used. Therefore, the research data was collected using semi-structured interviews with 12 experts in the field of private law who were selected using the theoretical sampling method; It was collected and it has been coded, analyzed and explained by applying the theme network method through the process of theoretical coding in order to discover the basic, organized and comprehensive themes and design the model.
Findings: The research showed that the conceptual network model of challenges in the field of acquisition and exploitation of national lands from the perspective of fundamental rights includes three comprehensive themes: legal challenges in the field of natural resources, the existence of unstable management in the field of natural resources, neglecting damage. Environmental problems and the loss of natural resources have reached theoretical saturation.
Conclusion: In order to "validate" the themes and the built model, two methods of validity evaluation are used in the communication method and the audit method, and for the purpose of "reliability assessment" are used two methods of reproducibility and transferability or generalizability.
