شناسایی چالش ها و فرصت های کاربرد تکنولوژی های نوین آموزشی در تسهیل یادگیری مفاهیم فقهی و حقوقی: یک مطالعه کیفی

این پژوهش با هدف شناسایی چالش‌ها و فرصتهای کاربرد تکنولوژی های نوین آموزشی در تسهیل یادگیری مفاهیم فقهی و حقوقی انجام شد. با توجه به ماهیت انتزاعی این مفاهیم و تحولات فناورانه، این مطالعه کیفی به بررسی ادراکات، تجربیات، فرصت‌ها و چالش های بکارگیری ابزارهایی نظیر واقعیت مجازی، شبیه‌سازی‌ها و پلتفرم‌های تعاملی از دیدگاه استادان و دانشجویان فقه و حقوق و متخصصان تکنولوژی آموزشی پرداخت. این پژوهش از نوع کیفی بود. داده‌ها از طریق مصاحبه‌های عمیق نیمه‌ساختاریافته با ۱۸ نفر از استادان دانشگاهی و حوزوی در رشته‌های فقه و حقوق، و متخصصان تکنولوژی آموزشی که با روش نمونه گیری هدفمند و گلوله برفی انتخاب شدند، جمع‌آوری گردید. تجزیه و تحلیل داده ها به صورت همزمان با گردآوری و با استفاده از رویکرد گام به گام تحلیل مضمون صورت پذیرفت. یافته‌ها در سه مضمون اصلی طبقه‌بندی شدند: فرصت‌ها و پتانسیل‌ها (تقویت درک عمیق، افزایش دسترس‌پذیری و انگیزه)، چالش ها و موانع (محدودیت‌های زیرساختی، مقاومت فرهنگی و مشکلات محتوایی)، و راهکارها (سرمایه‌گذاری در زیرساخت‌ها، آموزش نیروی انسانی و توسعه محتوای بومی). پژوهش نشان می‌دهد که فناوری های نوین پتانسیل زیادی در تسهیل یادگیری مفاهیم فقهی و حقوقی دارند، اما برای پیاده‌سازی موفق نیاز به برنامه‌ریزی جامع برای رفع موانع و توجه به ابعاد اخلاقی و حقوقی است. این نتایج می تواند به سیاست‌گذاران آموزشی کمک کند تا فناوری را به طور مؤثر در آموزش فقه و حقوق یکپارچه کنند.
The present study was conducted with the aim of identifying the challenges and opportunities in the application of novel educational technologies to facilitate the learning of jurisprudential and legal concepts. Given the abstract nature of these concepts and technological advancements, the qualitative research explores the perceptions, experiences, opportunities, and challenges of utilizing tools such as virtual reality, simulations, and interactive platforms, from the perspectives of law and jurisprudence professors, students, and educational technology experts. The study employed a qualitative approach, with data collected through semi-structured in-depth interviews with 18 university and seminary professors in the fields of law and jurisprudence, and educational technology specialists, selected through purposive and snowball sampling methods. Data analysis was conducted concurrently with data collection, using a step-by-step thematic analysis approach. The findings were categorized into three main themes: Opportunities and Potentials (enhancing deep understanding, improving accessibility, and boosting motivation); Challenges and Barriers (infrastructural limitations, cultural resistance, and content-related issues); and Recommendations (investing in infrastructure, training human resources, and developing localized content). The study demonstrates that modern technologies hold significant potential in facilitating the learning of legal and jurisprudential concepts. However, successful implementation requires comprehensive planning to address barriers, enhance human competencies, and consider ethical and legal dimensions. These findings can guide educational policymakers in effectively integrating technology into higher education in law and jurisprudence.
