چکیده:
از قواعد حقوقی می توان به عنوان قضایایی که روابط انسانی را تنظیم و تنسیق می نماید و به طور کلی شاکله رفتاری انسان را در چهارچوب مادی تبیین می کند ، نام برد. بسیاری از قواعد حقوقی ملهم از آموزه های فرهنگی یک جامعه بوده اند که شکل گیری حقوق را با استواری و صلابت ناشی از پذیرش عموم جامعه تسریع و تسهیل بخشیده است. فرهنگ از دیرباز یک مقوله بسیار جامع و فراخی می باشد که صرفا معطوف به شناخت حدودی که به لحاظ مادی و معنوی واقعیت موضوعی داشته باشد ، نیست بلکه فرهنگ از مقولاتی تشکیل یافته است که گاها حتی با وجود عدم انطباق با واقعیت از اعتبار مطلقی برخوردار است. از اینرو ساختار اجتماعی فرهنگ در چنین فروض غالبی قطعا مستحیل می شود.
این پژوهش بر آن است تا فرهنگ را به عنوان سنگ بنای شکل گیری حقوق از طریق تحلیل بنای عقلی دخیل در روند مذکور ایضاح نماید.

Abstract: Legal rules can be considered as propositions that regulate and harmonize human relations and generally
explain the pattern of human behavior within a material framework.
Many legal rules have been inspired by the cultural teachings of a society, which have accelerated and facilitated the formation of law with the stability and solidity resulting from the acceptance of the general public. Therefore, the social structure of culture is definitely impossible under such dominant assumptions.

This research aims to clarify culture as the cornerstone of the formation of law through the analysis of the intellectual foundation involved in the aforementioned process.
