چکیده مقاله :
با ظهور فناوری‌های نوین و استفاده گسترده از پهپادها در عرصه‌های مختلف، چالش‌های فنی و حقوقی کنترل سایبری این ابزارها به یکی از مسائل حیاتی تبدیل شده است. این پژوهش به بررسی این چالش‌ها و تأثیرات آن‌ها بر امنیت ملی، حریم خصوصی و حقوق بشر می‌پردازد. یکی از مسائل اصلی در این حوزه، آسیب‌پذیری‌های سایبری است که ناشی از وابستگی پهپادها به سیستم‌های نرم‌افزاری و ارتباطی می‌باشد. نفوذ به این سیستم‌ها می‌تواند به از دست رفتن کنترل بر روی پهپادها، سرقت اطلاعات حساس و حتی استفاده‌های نادرست از این فناوری‌ها منجر شود. این موضوع به‌ویژه در شرایطی که پهپادها در عملیات‌های نظامی یا نظارتی به کار گرفته می‌شوند، می‌تواند عواقب جبران‌ناپذیری داشته باشد. علاوه بر چالش‌های فنی، نبود چارچوب‌های قانونی مشخص و کارآمد برای تنظیم استفاده از پهپادها نیز از دیگر مسائل مهم در این حوزه به شمار می‌رود. قوانین موجود غالباً قادر به پوشش تمامی ابعاد پیچیده این فناوری‌ها نیستند و این مسئله می‌تواند به نقض حقوق بشر و حریم خصوصی منجر شود. پژوهش حاضر با هدف شناسایی و تحلیل این چالش‌ها، تلاش می‌کند تا راهکارهای عملی برای مقابله با مشکلات موجود ارائه دهد.
With the emergence of new technologies and the widespread use of drones in various fields, the technical and legal challenges of cyber control over these tools have become a critical issue. This research examines these challenges and their impacts on national security, privacy, and human rights. One of the main issues in this field is the cyber vulnerabilities stemming from the dependency of drones on software and communication systems. Breaches into these systems can lead to loss of control over drones, theft of sensitive information, and even misuse of these technologies. This is especially concerning when drones are employed in military or surveillance operations, potentially resulting in irreparable consequences. Besides technical challenges, the lack of clear and effective legal frameworks to regulate drone usage is another significant concern. Existing laws often fail to address all the complex aspects of these technologies, which can lead to violations of human rights and privacy. This research aims to identify and analyze these challenges and offers practical solutions to address the current issues.
