        According to the legal and jurisprudential rules of Islam, insult, rudeness and slandering Muslims and even non-Muslims from other divine religions is forbidden. This prohibition is to the extent that it is prescribed for some penance or (legal) punishment. The criminalization of blasphemy in Islamic law is the treatment of factors that endanger "public order and morality" and are considered "crimes against the spiritual dignity of individuals"; Because in a religious society, especially a society based on religious government, how can it be insulting, given the strong public opinion of the followers of the divine religions to the saints and religious leaders, who in addition to having a special legal personality, also have a special true personality?         Insulting to things that are sacred and respected for other religions and it is a faulty act from the point of view of the holy Sharia of Islam. The important verse "La Tasabbu Al-Lazina Yadoona Men Dunellah Fayasabbu Allah Adovan Beghayre Elm" expresses this issue. It is important to note that this action can not only be done verbally, but the general verse includes any action that involves insult. On the other hand, it is not only the sanctities of religions and idols that are subject to this ruling. There are some reasons why everything that is for others, and insulting them causes insults to the holy things, including the essence of God, the saints, etc., is prohibited in the holy verse. From the founding of the primitive societies, believing in the holy things has been available and has appeared in the forms of Fetishism and Toteism. In The Islam there are also some affairs that they are respected the religious holy things because of their purity and closeness to God. In this case it is not allowable to violate them. Profanation and violation in Islam are the important matters in religious jurisprudence and they have different chapters which can be categorized under these two subtitles: (a) obligation of respecting the rites, and (b) prohibition of violating the holy things. These topics were discussed in Makaseb, Moharrame, Taharat, Salat (pray), Soum (fast), Haj, Nekah(marriage), and Talaq (divorce). These religious holy things that are the subject of violation and profanation could be divided into the following overall categorization: 1. The profanation to the religious principles,2.         In accordance with the contents of several Quranic and Sunnah statements, not only curst upon people proved to be lecher or infidel is legal, but, in some cases, it also is essential. Unlike some Sunni jurisprudents suppose, this curst is not legal only upon such people’s nature or characteristics. In mentioned verdict, of course, one must observe whatever essential for maintaining unity among Islamic sects; this is due to different perspectives about correctness of rituals and beliefs among those sects. What, according to idea of a sect, feature implying deviation and infidelity of a person is proved? According to Islamic jurisprudence and Jafari jurisprudence in particular, can the obligated person, reciting reasons, do curst upon that particular person? Maintaining Islamic system depends on maintaining Muslims’ unity, and this will not be accomplished by neglecting the respect of any Islamic sect toward the sacred issues of other Muslims; therefore, by emergence of a secondary title, offense or insult, even in the form of curst upon the lecher and infidel people respected by a sect of Muslim is not legal and curst in such cases must contain general titles without naming special people.           There are two kinds of blasphermy in Iranian penal law which can be included the Hadd and Tazir. When the offender insult or relates the illegal intercourse to Holy Prophet, Imams and Saint Zahra, it will be the Hadd blasphermy (Article 262 of Islamic Penal Act), While insulting them which would not be Qazf or swearing or insulting other sacred will be Tazir blasphermy which is declared in 513 Tazirat Act. In this research with analytical- interpretative method, we will evaluate the elements of Hadd and Tazir blasphermy. Since the origion of this subject is rooted in Feghh, we will analyse the Feghh and Fatwas resources. The findings show that the differences between Hadd and Tazir blasphermy are related to the kinds of insult and subject of it. Hence, insulting Holy Prophet, Imams and Saint Zahra which consist of Qazf or swearing will be Hadd blasphermy, but insulting other sacred will be Tazir blasphermy. Manuscript profile
