Abstract :
A Jurisprudential and Legal Survey on Reflection of Fairness in the Special Legal Acts Siroos Shahriyari [1] Hamid Miri (Ph.D.) [2] Abstract With a view to foreign and domestic law and jurisprudence, it is appeared that there are streaks of making attention to the fairness factor behind of confronting some special legal acts such as usury and mortgage contracts, penal and non-liability clause. Emphasizing on the justice element in these instances is sometimes one of the most important basis for imitating freedom of contract and sometimes it is a subsidiary one as we can see the first position in the penal clause or usury contract. Apart from these common instances, it is possible to find some legal actions applied in a particular legal system; agreement entered into with expected heirs in English law and lesion in contract in the French law and Iranian law and jurisprudence does have such a feature.
