Abstract :
The Legal and Juridical Pathology of End-al-Estetaah (Payable in Case of Affordability) Condition in Mahriyeh (Dowry) Maryam Aghaei Bejestani [1] Mohammad Rohani Mogaddam [2] Jalal Araghi [3] Abstract Dowry as one of the aspects of marriage contract has been canonized to consolidate foundation of the family and prove man’s interest to the continuation family life. Dowry Division into end-al-motalebeh (payable on demand of wife) and end-al-estetaah (payable in case of afford of man) is a phenamenon that is posed in society and its pros and cons are adressing their views and proofs. According to marriage experts, acceptance of dowry with end-al-estetaah condition has raised challenges like jeopardy, suspension, creation of administrative challenges in collecting dowry. Some justify that dowry with end-al-estetaah condition not only does not jeopardize dowry but it does not also mean suspension of dowry. They believe that inclusion of such a condition is an appropriate solution to avoid too much dowries. Anyway, the authors believe that such a condition does not create a substantive problem at dowry but it confronts wife with many problems in proving affordability of the man in paying the dowry and in declining imprisonment right of the wife in in the realization of dowry being recognized as an outstanding debts.
