A new design in the mechanisms controlling political power (Case example: Allameh Mirzai Naini's reflections)

Abstract :
Considering that the Shia jurists believed that the governments that are governed by non-innocents are usurpers, Naini, in pursuit of the good political administration, prescribed supreme power for the government and a new paradigm of the concept of power and its limitation arose from the evidence of Islamic jurisprudence. In the light of Islamic government, he has brought forward the concepts of fundamental rights, including the need to limit the government's power, from jurisprudential and religious sources and introduced it from Islamic essentials for the first time in Shia history. With a little reflection, it can be found that his perceptions of the nature of government and the realm of political authority shaped the concepts of the modern state in the political thought of Shia jurisprudence. Considering that the knowledge of jurisprudence has the position that in the event of changes in the concepts of law, it can become a source of extraction of modern political thought; As modern theories were developed from Christian theology. The purpose of this article is to delve into the thoughts of Mirza Naini, who was an important thinker and an example of Iran's modern politics.
