Abstract :
With the emergence of the phenomenon of open source software and the widespread acceptance of this type of software, several legal issues, such as the definition of the concepts and nature of this approach and its licenses, are issues that require discussion and examination. Accordingly, the purpose of this article is to examine the question of what are the characteristics and legal nature of the open source software license and what are its benefits? This article is descriptive-analytical and uses a library method to examine the question in question. The findings indicate that the right to use open source software is in its essence a type of license agreement (license), with the difference that the material rights of the creator of the original software are very limited compared to proprietary software, and the licensee has certain rights, but in general these licenses do not go beyond the scope of literary and artistic property rights. The open source system is a system that was created in parallel with the intellectual property rights system to support and develop the software industry in accordance with scientific and economic needs. Reducing costs, increasing creativity, ensuring freedom of information and the right to access knowledge, and securing the rights and interests of consumers through creating a competitive market and benefiting from commercial credibility, attracting investment, and low prices are some of the benefits of supporting the open source software system. According to Iran's existing laws, Iran's laws on open source software are incomplete and there is a need for legislation on this issue.
