Abstract :
The Law on Prevention and Combating Fraud in the Preparation of Scientific Works with the aim of creating a hall for the research space of the country was approved in 2017. Apart from the objections to this law, such as its focus on the disabled rather than the perpetrator, there are other questions about this law, such as whether the principles of criminality have been taken into account in the drafting of this law or not. In fact, the behavior of the producers of scientific works who present their ideas to others with their consent for the applicants and by receiving a fee, is consistent with which of the principles of criminalization? If we consider the most important basis of criminalization as the principle of harm, what are the basic and vital benefits of this behavior? In addition, what is the criminalization of this behavior with the fundamental principle of the right to employment? This article seeks to answer these questions.
