Abstract :

The realm of transactions is the realm of the sovereignty of the will, and individuals act on the transaction or its dissolution with their will. One of the important issues that has been ignored in the statement of the jurists and jurists on the effect of the sovereignty of the will is the citation of the rule of fallen and unreturnable. According to this rule, if a debt or right is forfeited, it is not possible to restore it and return it to the responsibility. The basis of this view is the confusion of the world of credit governing transactions with the world of reality and the analogy of the forfeiture of debt with the decay of material and physical objects. This rule has been cited in cases such as the refusal to refer to the iqā'at, the refusal to return a forfeited debt to the responsibility. Some jurists and jurists have said that the restoration of the forfeited is not possible at all, some have said that the restoration of the forfeited is not possible and the restoration of something like it is possible, and finally, some believe that the restoration of the forfeited individual himself is possible. This research, using a descriptive-analytical method, while rejecting the arguments and arguments of those who hold this view, and considering evidence such as the principle of the sovereignty of the will and the distinction between the status of validity and truth, proposes to amend and restore this rule. With the support of jurisprudential evidence, it believes that a nullity is not possible if it is in a definite form, but it is possible if it is in a conditional and uncertain form.
