Abstract :

Jurisprudence rules have a great effect in adapting the constants of jurisprudence-legal issues to changes in society's issues; Of course, in cases where there is a way for changes, unlike issues such as dowry and inheritance, which at first glance seems to be against the rule of justice. The present study, with descriptive and analytical method, is trying to reread the rule of justice and the solution to resolve the conflict between them, and it has come to the conclusion that firstly, the rule of justice means putting everything in its proper place, which is referred to as legislative justice in the position of falsification. and it is related to divine actions, which is free from any unjust ruling in terms of gender, and with this understanding, it is different from the rule of justice and fairness. Secondly, the rule of justice and fairness is for financial disputes, which has the ability to spread to other cases, contrary to the rule of justice. Thirdly, there is no conflict between the rule of justice and the view of Imami jurisprudence and laws.
